1. About this policy

DAMCON Pty Ltd ("DAMCON", "we", "us") is a specialist formwork, reinforcement and concrete placement (FRP) contractor operating in New South Wales and Queensland. We are committed to protecting the personal information we handle and to complying with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This policy explains what personal information we collect, how we collect and hold it, the purposes for which we use and disclose it, and how you can access or correct your information or make a complaint.

2. What personal information we collect

The kinds of personal information we collect depend on your dealings with us, and may include:

  • Your name, phone number, email address and company or organisation;
  • The content of enquiries you send us, including tender, general, employment and supplier enquiries;
  • Documents you provide to us, such as tender documentation, drawings, specifications and RFQ material;
  • If you apply for employment — your resume, cover letter, licences, tickets, qualifications, work history and referee details;
  • If you are a client, supplier or subcontractor — business contact details, ABN and information needed to establish and manage the commercial relationship;
  • Records of our correspondence with you.

We do not ask for sensitive information (such as health information) through our website. If you choose to include it in material you send us — for example in a resume — we will handle it in accordance with this policy and only with your consent.

3. How we collect personal information

We collect personal information directly from you wherever practicable, including when you:

  • Submit an enquiry through the contact form on our website;
  • Email, phone or write to us, or meet with us in person or on site;
  • Apply for a role with us or are engaged as a supplier or subcontractor;
  • Deal with us in the course of tendering or delivering a project.

We may also collect information about you from third parties where it is reasonably necessary for our functions — for example, from referees you nominate in a job application, or from head contractors and clients in connection with a project.

4. Why we collect, hold and use personal information

We collect, hold and use personal information for purposes including:

  • Responding to your enquiries;
  • Preparing, assessing and responding to tenders and requests for quotation;
  • Assessing employment applications and managing recruitment;
  • Establishing and managing relationships with clients, suppliers and subcontractors;
  • Meeting our legal, regulatory, safety and contractual obligations, including workplace health and safety requirements;
  • Internal record keeping and administration.

We do not use your personal information for direct marketing, and we do not sell personal information to anyone.

5. Disclosure of personal information

We may disclose personal information to:

  • Our employees and related entities, on a need-to-know basis;
  • Service providers who help us operate our business — such as IT, website hosting and form-processing providers, and professional advisers (lawyers, accountants, insurers);
  • Head contractors, clients and project stakeholders, where relevant to a tender or project you are involved in;
  • Government agencies, regulators and other parties where required or authorised by law.

We require service providers who handle personal information on our behalf to keep it secure and use it only for the purpose for which it was disclosed.

6. Overseas disclosure

Enquiries submitted through our website contact form are processed by Jotform Inc., a form-processing provider whose servers may be located outside Australia (including in the United States and Europe). By submitting the form, you consent to your information being processed by that provider. We take reasonable steps to ensure any overseas recipient handles personal information consistently with the Australian Privacy Principles. Otherwise, we do not routinely disclose personal information overseas.

7. Storage and security

We hold personal information in electronic systems (including secure cloud services and email) and, where necessary, in hard copy at our offices. We take reasonable steps to protect personal information from misuse, interference, loss, and from unauthorised access, modification or disclosure — including access controls, password protection and restricting access to personnel who need the information for their role.

We keep personal information only for as long as it is needed for the purposes described in this policy or as required by law, and then take reasonable steps to destroy or de-identify it.

8. Website data

Our website does not use advertising or tracking cookies. Like most websites, our hosting provider may automatically log standard technical data (such as IP address, browser type and pages visited) for security and performance purposes. This data is not used to identify you.

9. Access and correction

You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete or misleading. Contact us using the details below. We will respond within a reasonable period and will not charge you for making a request. If we refuse access or correction, we will give you written reasons and information about how to complain about the refusal.

10. Complaints

If you believe we have breached the Australian Privacy Principles or mishandled your personal information, please contact us first using the details below. We take complaints seriously and will investigate and respond within a reasonable period, usually within 30 days.
